What the court handles
- decedents' estates, with a will or without one;
- appointment of personal representatives and conservators;
- guardianships for minors and for adults, including developmentally disabled adults;
- protective proceedings and commitment proceedings.
Opening an estate in Macomb County
Where the estate is not contested, it is generally opened informally and proceeds without ongoing supervision. The filing package normally includes the application or petition for probate and appointment, the acceptance of appointment, the protected personal information addendum, and a certified copy of the death certificate showing a Macomb County residence.
- the statutory filing fee to open an estate, currently $175;
- the inventory (gross estate) fee, calculated on the value of the estate;
- the cost of publishing notice to creditors;
- certified copies and letters of authority.
Hearings in Macomb County may be held in person or remotely depending on the matter and the assigned judge, so read the notice of hearing carefully rather than assuming a trip to Mount Clemens is required.
Timing and cost
A clean, uncontested Macomb County estate can be finished in a few months. Where the family home has to be emptied, appraised, and sold, the realistic planning number is six to twelve months. Notice to creditors opens a window in which claims may be presented, and the estate generally waits that period out before final distribution. The inventory fee scales with the value of assets passing through probate, so a larger estate pays more in court charges for the same work.
The most expensive mistake
Situations we see most often
Nothing was signed
Michigan's intestacy laws decide who inherits and the court decides who administers. That can mean extra steps, and a hearing, before anyone has authority to act.
Blended families
Where a surviving spouse and children from an earlier relationship both have claims, an out-of-date plan turns into a dispute the court has to settle. This is exactly what a trust with staged distributions is designed to prevent.
An heir who cannot act
Where a beneficiary has a disability or is a minor, distributions can jeopardize benefits or require a conservatorship. Special needs and minor-children planning is done before death, not after.
